HOMEOWNERS HELPING HOMEOWNERS: $1,815.09 IS ALL HOMEOWNERS OWES TO BRING THEIR MORTGAGE CURRENT. YET WELLS FARGO CHANGED THEIR LOCKS, WINTERIZED THEIR HOME, AND WITHOUT ANY NOTICE TO THE HOMEOWNERS.

PLEASE HELP PREVENT ANOTHER WELLS FARGO FORECLOSURE AGAINST AN INNOCENT HOMEOWNER -- THIS IS ABSOLUTELY UNCALLED FOR!

Dear Mr. Oberstar, Ms. Klobachar, Mr. Franken,

We are writing to you as we need your help and/or guidance with our Wells Fargo Mortgage. We have heard there is a Class Action Lawsuit against Wells Fargo and need to know how to become a part of this.

We had to temporarily move to Tucson, AZ in March 2010 for my employment. At this time I am on Short Term Disabilty for severe depression. My husband is disabled. We had a house sitter until the end of September when she moved back to ND. Since then my father who lives in Hermantown (3 miles away) has gone by daily and he has kept the yards in a manicured state. He cut the grass, cleaned up any debris, and checks inside the house daily to make sure everything is running ok. With all of the snow that has fallen in Duluth he saw no reason to shovel the drive until he knew we were on our way home. He has also put thermometers in the 3 of the windows so he can monitor the inside temps.

We purchased our home for $157,000 in 2007; of which we paid $60,000 down; we currently owe around $92,000. There is a lot of equity in our home. It is our life savings and we can not afford to lose it, but, Wells Fargo has everything to gain by taking possession of it.

We have fallen behind in our mortgage payments due to unforeseen medical expenses, and having to pay for our rent and utilities here and our mortgage and utilities in Duluth.

My husband fell and broke his hip in April and we were inundated with almost $3000 in medical bills as we do not have any supplemental insurance. Then he fell again in November and jammed 3 of the vertebrae in his neck. We have been going to intense physical therapy treatments three times a week since his fall. We are paying $105.00 a week for these (which we truly do not have the money). Wells Fargo is showing we are 3 months in arrears; I made a payment to them on the 22nd so actually we are 1 month, plus $309.00s in arrears as December is not over yet. They are holding $500.00 towards a payment until the other $309.00 is paid. They only post complete payments to your account.

We are trying to make up the back payments the best that we can. After many conversations with Wells Fargo, we were transferred to a Debt counselor and after over an hour on the phone he stated we should qualify for the HAMP program. We received the paperwork from him and filled it out and sent it back. We never had a single response from them. Then I called several times again and finally spoke with another employee and they said we did not qualify as we were not living in the house.

It seems that Wells Fargo has engaged with CMS to watch the property of which they are charging us $15.00 a month for a drive by. This fee started in May 2010. Also, we will have new charges from CMS as they took possession of our home, changed the locks so my father could no longer gain access, they plowed the driveway and they took it upon themselves to winterize our home by putting anti-freeze into the plumbing system (Wells Fargo says we will have to pay for all of these actions once they have been billed by CMS). I have since been able to get CMS to send one key back to my father so he is now able to gain access, but they retain the other 2 keys.

Please give us some direction or a help line that we can call--we cannot lose our home! It is all we have!

There are so many actions the homeowners write about here that Wells Fargo has committed that it is quite clear the homeowners have a few bones to pick:  Wells failed to give the homeowner any notice regarding a pending default; prior to changing locks; prior to winterizing home.  Wells always fails to first attempt to accurately assess the true situation before they jump.   I mean, can't they read the signals?   The furniture is still in the home, the utilities are still on...  Perhaps people have to visit sick relatives...do you ever consider the real world before you steal homes from homeowners?  Or are you so desperate for money, so money hungry, that you don't care if they houses you are taking don't belong to you?
