I am writing to you today in reference to a hardship letter for my late mortgage payments for May, June, July and August of 2009. We were happy to have received a loan modification back on 1/1/09. However, it should be known that when we applied / completed the paper work that corresponds with the modification, along with the countless phone conversations with various departments, it was made known that we would be late a few payments during the above listed months. We advised your departments that we can make our regular payments, except for the summer months, due to the fact that my wife, Jennifer Zide, is a teacher and WAS under the 9 month pay check scale / not year round pay. As you can imagine, it is a nightmare not getting payed for those 3 months.

In April of 2009, I contacted ASC again (please check caller notations / history of calls with ASC associates), to set up a repayment schedule of the known, up in coming hiatus of payments. ASC advised that there was nothing that they could do, since I was currently on time and not late yet. I was told that I would be contacted. I contacted ASC in Mid July, advising that I have missed payments and wanted to find out how to get caught up with them. I was told about a repayment plan, which I qualified based on my completion of questions. I was told to make a payment on August 28th of $2308, which WE THOUGHT would be no problem, since my wife, Jennifer would be back to work and receiving paychecks. HERE is where the problem really comes into play.
At the time of the agreement (in July) to become current, we did not know that her first check would actually be a week later, instead of August 28th, it was actually September 4th, ONE WEEK later. After finding this out, I called ASC back to let them know of her actual pay check status. I was advised that we would be breaking the agreement and would not be eligible for a new agreement due to the investors, thus I am writing this hardship letter. I called in on Sep 14th, 15th and 16th (three separate days) to make a payment of the $2308, but was denied. I have been trying to make payments, however, ASC is not taking them.

My wife and I have current (mostly recession proof jobs), since I am a police officer of 7 years and Jennifer is a teacher of 14 years. We have diligently and proactively been in touch with ASC for each and every situation, even before they have occurred. We have tried to make payments, which ASC says they cannot accept until this process is completed. WE ARE ACTIING IN GOOD FAITH, TO THE BEST OF OUR ABILITIES. Jennifer is now being paid on a 12 month basis, which obviously means that she will be getting checks every two weeks, including the summer months.

We have the ability to pay our regular monthly payment plus put a little more to contribute towards paying the past due amount. I am hoping that we can either put the four late payments in the rear of the loan, complete a forbearance, or modification of some sort. Due to the value of my home at $320,000 vs. what I owe, $421,000, it would be in all of our best interests to work something out. I know ASC / Wells is not looking to have another foreclosed property (as the cost is so expensive for both parties). I am currently in bankruptcy (Florida Southern District case # 07-19813), but kept this home / loan out of it, for the simple fact that I want to remain in my home and even one day own it out right. I did not and do not want to walk way from it. It doesn't help you or me to do that. So, please, accept my hardship situation as stated above and let it be known that with our income and expenses, we are able to again pay our payments and keep this home of our the courts and make it a success story for all involved.

Thank you for your time and considerations. We are keeping the mortgage payments that we tried to make and future ones (while this is being sorted out) in a money market account, in hopes that you accept our payments in the very near future.

I want to thank you for your Wells Fargo site. I have just e-mailed the 4 people you listed. I will see if I can get a response.

Below is the e-mail I sent to them. This has been an ongoing fight since April

...with them wanting the same things re-sent to them, because "they want their files updated monthly", you name it..... The thing that really has gotten me the angriest is them trying to deny me because my debt ratio is too high, which is because of their loans!!!!! I only have one credit card debt, all the rest is them and they won't come out and admit it. They keep ignoring me.

They set up a seminar in Phoenix that I have an appt to go to on Wednesday. I have a feeling I am going to waste my time. They claim they are going to do modifications right then and there. Well.....why can they do that but not finish mine? I'll learn then.

I just don't know what to do if they still refuse to modify both my loans. It was my understanding that banks are modifying both mortgage loans and home equity lines. I even wrote the federal bankruptcy judge that is pulling in WF to explain their problems to let him know what my situation is.

This is what is going on with me (what I wrote the 4 people.)

I am one of your customers requesting your help with these modifications. I went thru the Hope Foundation to try to get my mortgage and home equity line rolled into one loan with a 3% rate, since every time I called Wells Fargo I was given a different phone number and nobody would give me any form of help. The Hope Foundation faxed the to Wells Fargo. Since April, Wells Fargo had told me they could do this modification. Now, I was just told that they cannot do this and they are only trying to modify my main loan AND the modification department has been denying it due to a high debt ratio (because of the home equity line thru Wells Fargo which was never fully used!)

There is a balloon payment on the home equity in 2 years. That was the reason for the modification request and because my husband has not had a raise in four years while our bills keep rising, so we have not had enough to cover all bills. The Hope Foundation told me that Banks are combining mortgages and home equity lines into one mortgage to help the struggling homeowners.

Why is Wells Fargo not????? I have had customer service reps get quite rude with me (ex: why do you need a modification? You have $92. left over at the end of the month after bills! If people would look at the financial statement, that means I have no money to pay toward any principle on the home equity line and nothing for emergencies). I am requesting help with this. My payments have never been late and my husband and I both have high FICO scores, besides being a customer of yours for 8 years with our banking. I do have an appt. Wednesday in Phoenix to meet with a rep. but have a feeling we are going to run into all the same problems that I've had from the beginning. I am requesting a response.

I want to thank you SO MUCH for taking the time to write and share what is going on with you in your life, in your heart, so we can start praying NOW!!! for an awesome outcome.

PROMISE ME you will also immediately send your heartfelt e-mail to Matt Heil. I've given you his contact information in the next paragraph, and also above. You will also see in an e-mail I'm going to send you after I post this in our blog (you are experiencing EXACTLY THE SAME ISSUES EVERYONE ELSE WHO WRITES IS EXPERIENCING AND YOUR LETTER IS GOING TO GIVE THEM HOPE) a great deal of contact names who will be receiving YOUR DETAILED INFORMATION, and their goals are to MAKE THINGS HAPPEN.

Matthew Heil, Cara, Mary and Sharon are wonderful, but Matt, lately, has been the one to make thing happen VERY VERY FAST. So, it sure can't hurt to go ahead and contact him as well, follow up with a call to each one of these people (even if you only get their voice mails) AND I MEAN CALL HIM FIRST THING IN THE MORNING.

I've learned, the ONLY way to get a response to YOUR issue, (they are bombarded with thousands every day -- so you have to make yours stand out) You have to be committed to be a big BOTHER, BOTHER, BOTHER. I can tell you aren't like that. When I started, I had never been like that. I could have saved my home. I know that NOW!

BUT, you CAN save your home, if you just for now commit to being a BOTHER, BIG ANNOYING BOTHER. The squeaky wheel gets attention. AND IF YOU DON'T GET THE ATTENTION YOU NEED CALL ME.

I've stayed up all night with people to motivate them, I've called with people, I've gathered groups together to picket, I've helped people people prepare documents to present themselves in Court Pro Se, sometimes I stand in Court with them. I'll walk through this with you because I understand it is hard. It is scary.

BUT YOU'VE HUNG ON SINCE APRIL.

I'm going to post this now, and I'm going to finish working on a Rhode Island case.

When you call Matthew Heil today, ask him if you even need to go to the Phoenix meeting -- maybe he can finalize everything for you over the phone. (He usually does.)

If you do have to go to the meeting, ask him to find out who you will be meeting with, their title, their true qualifications (will they really be able to confirm mods right there -- reinstatements better with past due amount added to the back end like they do for most with no additional fee added -- hey tough times and bail out funds. Wells Fargo has promised to use those funds to help people. It is no skin off their back. Have them combine your loans, 3%, 30 year conventional, reinstatement, missed payments tacked on to the back, with the next payment due in two months -- give you some breathing time.)

Do this, let me know his response ASAP.
