      @chunga agreed good lip service but they, pretender lender still own NOTHING and are and will rape the people further with a mod, stall tactic but will give some people room to regroup and to fight back. Then we will go to another tier of illegal mods very possibly as MERS will be everywhere on this mod unless they have gotten smarter. Wait and watch, then people file BK and do quite title cause in federal court it is a different animal altogether, the crooks will then have to pay more attention to what they are NOT doing right and that they DO NOT have clear title to rape any longer and will NEVER have clear title as this has blown up in their greedy a$$e$, a rather funny mental picture to me right now. People are getting smarter and people are getting angrier and people are just plain fed up. We want back what we have worked so hard to have so little of and NOW!!!! So no more lip service from me, I have to go to a fight! Thanks 4closure for being the beacon to ALL!!!!!!

        The pretender lenders will have to square that up with Attorney Babcock.
        If they think they can pull the wool over his eyes…well, good luck with that. That will be a very risky affair. I’m sure they are aware of the consequences…lol.

Springfield Passes Tough
Anti-Foreclosure Legislation

SPRINGFIELD, Mass. (WGGB)-- The Springfield City Council takes strong action to reduce the number of foreclosures in the city.
On Monday night, the council passed a measure which supporters say gives Springfield the toughest anti-foreclosure legislation in Massachusetts.
The strong anti-foreclosure vote by the Springfield City Council had supporters like Destry Sibley of the "No One Leaves" coalition celebrating. "I think it's a great vote, I think it's a huge success for us and I think it's going to be a really important step in the anti-foreclosure struggle," says Sibley.
The two ordinances that were passed increase requirements for foreclosing institutions.
The first requires that foreclosing banks pay a $10,000 cash bond to assist the city in securing and maintaining vacant properties. "This is way to level the balance sheets and essentially making the banks pay for the costs they're incurring on the city," says Destry Sibley.
The second ordinance requires the banks to enter into good faith mediation with homeowners before foreclosing.
The city council vote was unanimous is passing the anti-foreclosure legislation .
City Council President Jose Tosado says it is good for the community and good for families."I think it was a critical vote, I think it was the right thing for the city council to do. I couldn't be more proud of the city council for standing up," says Tosado.
Springfield ranks high on the state foreclosure list.
The latest numbers show Springfield running second only to Boston in foreclosures.
Supporters of the new anti-foreclosure legislation like City Council President Jose Tosado say the measure helps put a face on the numbers, "These are homes, these are people's lives, they're raising their kids, so I think we need to work with lending institutions in order to help people get their fair shake," says Tosado.

EDITOR’S COMMENT: Up until now, there has been an impenetrable trap-door for homeowners who were the victim of a fraudulent foreclosure — especially in States like Arizona and California where  sales of property are held without judicial review. The pretender lenders are simply forming companies that substitute trustees and other parties — essentially appointing themselves as judge, jury and executioner.
Then when it’s all over, and the bogus  auction results in the issuance of a deed in foreclosure, the homeowner is faced with an eviction lawsuit in which the rules say he can’t challenge title — even if he has evidence of forgery and fabrication of documents. Now, The highest court of Massachusetts, has said that is a loophole it is closing. The Judge MUST hear the challenge if the allegation is that the party seeking eviction is alleged to have acquired title illegally.

The state’s highest court has ruled that people fighting eviction from homes they lost to foreclosure can challenge the validity of a property seizure in housing court after the fact, a decision advocates for homeowners’ rights are calling a major victory.
The Massachusetts Supreme Judicial Court’s unanimous ruling, released today, involved KC Bailey, a Mattapan man whose home was taken back by the lender through foreclosure. In 2009, Bailey contested his eviction during a housing court proceeding, saying the foreclosure process itself was flawed.
In court, Bailey claimed he only learned of the 2007 foreclosure when he found an eviction notice taped to a fence surrounding his property. He refused to leave the house on the grounds he was not given proper notice of the sale.
Bank of New York, which wanted to evict Bailey, argued that the housing court didn’t have the authority to consider a challenge to a foreclosure that had already been finalized, and the judge agreed. Bailey appealed and the Supreme Judicial Court decided to take the case. As a result of its ruling, the case now goes back to housing court.
