WELLS FARGO QUICKLY CORRECTS AUTOMATIC DEDUCTION ERROR

Kelly,
The funds hit my account Wednesday evening. I paid and then asked for
a letter from each of the payees of the automatic deductions that were
rejected documenting the charges assessed.

Stephanie Santi contacted me yesterday morning to advise that the
wire had been initiated. She later called to clarify that since
I belong to a small FCU, the funds might have to go through another
company before being placed in my account. My credit union told
me that was the case. It might not be deposited until Thursday.
Stephanie also asked for documentation as to the NSF charges by
the credit union. I faxed those yesterday afternoon. I am in
the process of documenting the assorted charges by Am Ex and the
utility companies for her.

Keep me updated. I'm certain Wells Fargo will provide full
restitution. Wells Fargo would not allow a valued account
holder to suffer the brunt of their employee's gross negligence. You
will not suffer any further due to this unfortunate mishap.
Certainly, reparations will be calculated and credited to your
account.

Please advise exactly what actions have been taken since you
last reported your experience to me. What costs have you
incurred thus far? Include all penalties charged by your bank
and other creditors for the incorrect report of "insufficient
funds" on your account. Obviously your account would not have
been insufficient has Wells Fargo not erred. And did Stephanie
Santi offer to provide you with a letter acknowleding their
errors? You should have this in case a creditor requests such a
letter.

It is my "job" to keep track of the service you have received,
good and bad, by whom, so I can be sure to credit the
appropriate Wells Fargo Staff for their fast actions to resolve
your problems as well as advise Wells Fargo of the names of
their staff who fell far short of providing the customer service in
which Wells Fargo prides themselves.

We need your help to assist Wells Fargo in making corrective
measures, and to assist Wells Fargo in assessing what total
monies due you, to be credited to your account, so you do not
suffer any economic discomfort, nor any personal injustice.

Stephanie Santi called this afternoon to advise that, although it
was too late to stop payment and wire the funds to our account,
she would do it first thing tomorrow. I called my bank to make
them aware of the situation. As to the letter and reimbursement,
no mention was made by Ms. Santi but I will press the issue after
the funds are in my account.

or VP Mary Coffin, or their assistant Sharon Cecil, tell them
you need the letter. Offer to write it for them, but tell them it
needs to be written on their letterhead and signed by the
appropriate executive. Yo will need to show it to your other
creditors, your bank, and possibly the credit repositories to
correct any negative reports and to receive credits for ALL
PENALTY FEES you were charged.

This situation was NOT brought on by you, you did not make
the mistake. Demand to be reimbursed FULLY, and a letter. Please
keep in touch -- don't let a single day pass without contacting
Sharon Cecil.

When you have time, I also would like to know the numbers
you dialed to reach the customer service agents you mention in
your letter. Their unprofessional attitudes and comments, and
failure to provide you with resolution, needs to be addressed as
soon as possible.

My wife and I have a problem which I thought you might be
interested. Rather than restating it, I am sending you a copy
of the email and letter I am sending to those executives you
listed:

Our mortgage payment to Wells Fargo was structured to
automatically deduct from our checking account on the first of
each month. We streamlined our loan through another company to
reduce our payment in February 2009. Escrow closed and funds
were disbursed on Feb. 25. We were mistakenly told that our
payment for March had been canceled. On March 2 the payment
($1947) was taken by Wells Fargo from our checking account. I
called the same day and advised the person assisting me, "Joe",
of the situation. He advised that the funds would be returned
by wire the following day. On March 4, I called again to advise
that the funds had not been returned and that I needed them to
pay my bills. That person, "Janina", advised that records
indicated that they were in the process of returning them and to
give it until Thursday, the 5th. On the morning of March 6, I
called again and spoke to "Cece". She advised that records
indicated that the funds had been disbursed and that if they
were not in my account that day, to call again and speak to a
supervisor. I called that afternoon and spoke to a supervisor.
He advised that the other persons I had spoken to were mistaken.

He explained that by law the funds were being held and would be
disbursed later with the rest of the escrow account. By now, my
checking account contained $1.56, bills on automatic deduct were
being returned and I was being charged for each as a returned
check. Further, the companies who were being denied their
payments were also charging fees. The supervisor said he
understood our problem and would expedite the disbursement of
escrow funds.

The funds were disbursed on Friday, March 13 and sent to me by
mail. We have not received them. I have called twice since
then attempting to convey the impact to us. The last young lady with
whom I spoke (Friday March 20) advised that it was my fault
since
the terms under which I authorized the automatic deduction
"clearly"(?) stated that I had to advise Wells Fargo ten days in
advance to stop it. She further advised that I must wait
fifteen business days for the mailed payment to reach us before Wells
Fargo was required to stop payment and reissue. When I told her
that we receive mail from all over the U. S., and it arrives
within four days (not business days), she told me that this mail
was coming from Iowa (I guess Iowa must be on another planet).

So far, my car insurance payment is late (no insurance until
paid); American Express attempted to take their payment four
times from the account (they canceled my business card because
a "hard and fast rule"); my life insurance payment is late; two
of my utility payments are late. I should also include that my
wife is an epileptic and stress can and does trigger seizures.

I know that your company is legally not required to do
anything more than what has been done. You don't have to reissue until
April 3 and that you can just mail another check after that day.
If that is how you would want someone close to you treated, just
let me know and I'll stop bothering you. If you feel that your
company can do more, would you please stop payment and either
wire the money to my account or overnight the check. I would
gladly pay whatever it costs you to do that.

I am going to send this out tomorrow after I check my mail. I
will keep you posted.
