I am writing to you today in reference to a hardship letter for my late mortgage payments for May, June, July and August of 2009. We were happy to have received a loan modification back on 1/1/09. However, it should be known that when we applied / completed the paper work that corresponds with the modification, along with the countless phone conversations with various departments, it was made known that we would be late a few payments during the above listed months. We advised your departments that we can make our regular payments, except for the summer months, due to the fact that my wife, Jennifer Zide, is a teacher and WAS under the 9 month pay check scale / not year round pay. As you can imagine, it is a nightmare not getting payed for those 3 months.

In April of 2009, I contacted ASC again (please check caller notations / history of calls with ASC associates), to set up a repayment schedule of the known, up in coming hiatus of payments. ASC advised that there was nothing that they could do, since I was currently on time and not late yet. I was told that I would be contacted. I contacted ASC in Mid July, advising that I have missed payments and wanted to find out how to get caught up with them. I was told about a repayment plan, which I qualified based on my completion of questions. I was told to make a payment on August 28th of $2308, which WE THOUGHT would be no problem, since my wife, Jennifer would be back to work and receiving paychecks. HERE is where the problem really comes into play.
At the time of the agreement (in July) to become current, we did not know that her first check would actually be a week later, instead of August 28th, it was actually September 4th, ONE WEEK later. After finding this out, I called ASC back to let them know of her actual pay check status. I was advised that we would be breaking the agreement and would not be eligible for a new agreement due to the investors, thus I am writing this hardship letter. I called in on Sep 14th, 15th and 16th (three separate days) to make a payment of the $2308, but was denied. I have been trying to make payments, however, ASC is not taking them.

My wife and I have current (mostly recession proof jobs), since I am a police officer of 7 years and Jennifer is a teacher of 14 years. We have diligently and proactively been in touch with ASC for each and every situation, even before they have occurred. We have tried to make payments, which ASC says they cannot accept until this process is completed. WE ARE ACTIING IN GOOD FAITH, TO THE BEST OF OUR ABILITIES. Jennifer is now being paid on a 12 month basis, which obviously means that she will be getting checks every two weeks, including the summer months.

We have the ability to pay our regular monthly payment plus put a little more to contribute towards paying the past due amount. I am hoping that we can either put the four late payments in the rear of the loan, complete a forbearance, or modification of some sort. Due to the value of my home at $320,000 vs. what I owe, $421,000, it would be in all of our best interests to work something out. I know ASC / Wells is not looking to have another foreclosed property (as the cost is so expensive for both parties). I am currently in bankruptcy (Florida Southern District case # 07-19813), but kept this home / loan out of it, for the simple fact that I want to remain in my home and even one day own it out right. I did not and do not want to walk way from it. It doesn't help you or me to do that. So, please, accept my hardship situation as stated above and let it be known that with our income and expenses, we are able to again pay our payments and keep this home of our the courts and make it a success story for all involved.

Thank you for your time and considerations. We are keeping the mortgage payments that we tried to make and future ones (while this is being sorted out) in a money market account, in hopes that you accept our payments in the very near future.
