CONSUMERS - URGENT - SAVE AMERICA ONE MORTGAGE AT A TIME

PROTECT_US_PEOPLE

AMERICAS SERVICING COMPANY IS NOT A LEGAL ENTITY.  It was a dba - that is doing business as Norwest Mortgage. America's Servicing Company (a fictitious name for Norwest Mortgage) in 1999. 

Norwest  purchased the Wells Fargo logo and changed Norwest Mortgage to Wells Fargo Home Mortgage, Inc. which is a wholly-owned subsidiary of Wells Fargo Bank NA.

Wells Fargo Home Mortgage, Inc. legally registered in 2000 Domestic for Profit Corporation in CA. And other states Wells Fargo Bank NA registered Wells Fargo Home Mortgage, Inc. as a Foreign for Profit Corporation. Business continued as usual selling to consumer mortgages now using the Wells Fargo valuable logo.

Wells Fargo Home Mortgage, Inc. did not reregister the (trade name) dba Americas Servicing Company.  I don't know if this is a legal issue but  certainly these are facts.

Wells Fargo & Co/MN & Wells Fargo & Co & Wells Fargo Bank NA & WFC HOLDINGS CORP cooperatively engag in unlawful business acts and false claim actsand much more. Including and not limited to: Deceptive Adversting to influence consumer behavior, Antitrust violations restricting a free market selling loan originations of consumers only to Wells Fargo Preferred Vendors, and only to Wells Fargo Commercial Clients and only to Wells Fargo Subsidiaries and only cooperating with Investors who 'one hand wipes the other' launder in currency allowing for all consumer mortgages Wells Fargo Bank NA to be SERVICER of the asset-security (money laundering scheme) and pyramid schme (asset-debt) and Sarbanes-Oxley Act violations for accounting practices that will be revealed to show inflated treasury deposits.

For example one consumer mortgage mine. $440K appraisal. Greg Warhem sells us as a financial professional that the best use of our asset to pay down debt, to pay state, federal and municipal taxes, medical bills, and fix home repairs for two years in a fantastic market and to improve our credit would be to purchase the 80/20 Refinance Wells Fargo Mortgage package.

Wells Fargo Bank NA processed fraudulent loan origination documents on 6/5/2006 instructing the attorney WFHM Ajrona Leka (WFHM DIVISION) instructed Stephen R. Scipione Esq. on 5/30/06 that a closing would occur on 6/5/2006 and his staffer Debra Allegro and copied was Stephen R. Scipione instructing them to place on the Title Insurance 1st Mortgage $352K and 2nd Mortgage Star Mortgage Servcies $88K. Title Insurance in this case protects the LENDER and the consumer pays for the policy %$1,195 $352K and $895 $88K and so Wells Fargo Bank NAis protected against fraud (their own?)

Wells Fargo Home Mortgage, Inc why do they continue to use Americas Servicing Company trade name without registering the fictitious name ? When did they start to call ASC a division? If they are using on the internet the caption above that is to say Wells FArgo Home Mortgage, INc. dba Americas Servicing Company copyright 2010 is that a lye and unlawful business practices? and False Claim Acts ? and unlawfully engaging in intrastate and interstate commerce in all 50 states since Wells Fargo Bank NA by their own hand John Stumpof and Board of Directors had on the http://www.wellsfargo.com website thru early part of thrid week of January 2010 the America's Servicing Statement below.

See Wells Fargo's letter describing what Americas Servicing Company is (First it is a lie) and second Wells Fargo & Co, Wells Fargo Bank NA, Wells Fargo & Co/MN and WFC HOLDING CORP are intentionally misrepresenting and deceiving consuemrs that Wells Fargo Home Mortgage does sell consumer mortgages and they do not. Wells Fargo Bank NA only does loan originations and that is why they are the #1 Loan  -#1 Servicer and in either market bull or bear make their money while Wells Fargo Commercial Clients wind up hurting and Wells Fargo Commercial Clients who purchase higher yielding consumer products get harmed and Attorney General Edmund Brown in CA received in a no-fault claim against Wells Fargo Securites LLC (a different one than that with the same name today) for $1.5 Billion dollars for intentionally misrepresenting to consumers what the product was and a woman with Lung Cancer needed her money and found out the sales person from Wells Fargo (pattern and practice) LIED and she could not get her money in a week.

The $1.5 Billion payment did not hurt Wells Fargo who sold stock in the summer and got exactly $1.5 Billion - a wash. But luckily Attorney General Brown won the case and helped all of those consumers and the state of California.

Fact of the matter is Wells Fargo & Co DO NOT DO consumer mortgages THAT IS TO SAY CLEARLY 'WELLS FARGO BANK NA DOES NOT DO ANY CONSUMER MORTGAGES' THEY ONLY SELL LOAN ORIGIANTIONS FOR CONVERSION OF THE CONSUMER ASSET INTO DEBT TO WELLS FARGO COMMERCIAL CLIENTS, WELLS FARGO PREFERRED VENDORS AND WELLS FARGO 'ONE HAND WIPOES THE OTHER YOU KNOW 12.5 PESOS" WITH INEVESTORS WHO SHADOW THEM LIKE GOLDMAN SACHS.

This copy of Americas Servicing Company shows they don't know yet that Wells FArgo Home Mortgage, Inc. has been voluntarilly dissolved and merged out of existence in CA since May 2004 and is not a legal business entity.  The fact that America's Servicing Company displays this means they don't know they are a trade name (fictitious name) (trade name) and not a legal entity for they are not registered - not in NJ. Not in most states I checked. In OH America's Servicing Company is involuntarily dissovled for non-complaince when registered as Norwest Mortgage and no one sent in the required annual report and fee the trade name is no longer valid and the corporation is responsible for all transctions of business intrastate and interstate while not a legal entity.

This is to inform you on this date, the Office fo the Comptroller of the Currency (OCC) approved the application to merge Wells Fargo Home Mortgage, Inc., Des Moines, Iowa, into and under the charter and title of Wells Fargo Bank, National Association, San Francisco, California.  Wells Fargo Home Mortgage, Inc. is a direct wholly-owned operating subsidiary of the Bank.


This approval was granted based on a thorough review of all information available, including commitments and represenations made in the application and those of Wells Fargo & Company's representatives.


As a reminder, this Office must be advised in writing in advance of the desired effective date for the merger so that the OCC may issue the necessary certification letter.  The merger may be consummated on or after the date of this letter subject to the Bank having first received all other required regulatory approvals.  If the merger transaction is not consummated within one year from the approval date, the approval shall automatically terminate, unless the OCC grants an extension of the time period.


The OCC will issue a letter certifying consumation of the transaction when we have received:


1. A Secretary's Certificate for each entity, certifying that a majority of the board of directors approved the transactions, and


2. An executed Agreement and Plan of Merger.

Pursuant to conversion with Jennie Crawford, Des Moines, Iowa refers to the locale of an office and Wells Fargo Home Mortgage Inc is a California corporation and the one involved is the attached merger.

I am a consumer WHO PURCHASED MORTGAGE PRODUCT(S) FROM Wells Fargo Home Mortgage and by express and implied acts the salesman was an agen t selling me a contracted product of Wells Fargo Bank NA.


Greg Wareham is an employee acting as an agent and acting as a financial professional.  But upon investigation the Wells Fargo Home Mortgage employees have an unfair competitive advantage for they are not licensed.


Now some states changed the rules and in GA July 1, 2006 others could be the financial professionals.


I don't know what the NJ rules were on June 5, 2006.  I don't know what the rules were in MN when the 'closer on 6/5/2006' did the closing. I don't know that the rules are in TN when the transactions were processed between an alleged closing or was there a real closing? For why was Star Mortgage Services used? The entity did not exist in NJ. I cannot find a trade name. There is a UCC document in NJ. There are Star Mortgage, Inc. in MD SOS. and other states.


The NJ Department of Banking and Insurance had on record for a Star Mortgage Services (dissolved in 2003) a phone # and that Phone Number linked to Atlantic Home Loans, Inc. And that Phone # is the same on the fax sent from a company purporting to be WFHM, Perth Amboy. And Perth Amboy is the address of Atlantic Home Loans, Inc.  And Atlantic Home Loans, Inc. is in many states.  And I don't know but I bet at the time was a Wells FArgo Commercial Client, perhaps a Wells Fargo Preferred Vendor. Perhaps a Wells Fargo Commercial Investor.


Employee letters multiple from Bonnie Schooler and Janice Turner replying lies and they are in collusion and make statements on Behalf of John Stumpf lying.  For example, Bonnie Schooler who works for WFHM Division since 8/8/08 stated that the loan origination was fine for our closing.


In writing to serious allegations I intentionally recorded on the BBB which are moved from NJ Trenton BBB to Des Moines Wells Fargo Home Mortgage an unlicensed entity in Iowa engaging in intrastate and interstate commerce as who?

They sold on 6/5/2006 15% loan in secret to Star Mortgage Services for $88K which was really South Star Funding LLC dba Capital Home Mortgage MD corprorations and tradename found in NJ fictious name Captial Home Mortgage and South Star Funding LLC in TN.


Pyramid Scheme - 6/5/2006 - Fact of the matter is the National Bank Act has a 30 day hold period on not moving the sale of properties - does that not include the corporation who owns the asset (even if in fraud?) who with intent took the asset on 6/5/2006 and sold it to Wells Fargo Bank NA LENDER who sold it to others and created on a $440K appraisal a $507K debt in asset-debt conversion to currency.


Money Laundering Scheme And in addition separate money launding by investor in which Wells Fargo Bank NA as SERVICER accepts in the Frederick MD Treasury (which subsidiary???) (Which investor???) moving funds through Wells Fargo Home Mortgage Instituional Lending authorized by Wells Fargo Home Mortgage and Wells Fargo Bank NA/MN responsible for all of the transactions, 2650 Wells Fargo Way, Minneapolis MN is where the closer 'Jasmina Bevanda' and mortgage counselor 'Julie Sainio' work and when I called in one day asking for the closer Jasmian Bevanda told she was on vaction the employees stated she worked for Premier Asset Services.


Premier Asset Services is a Wells Fargo subsidiary. http://www.pasreo.com


The primary business of this subsidiary is to manage the foreclosed properties and Wells Fargo Preferred Vendors trained by Default Services (Default Resource) Frank Marshall - Hudson & Marshall have exclusive rights to list Wells Fargo properties. Wells Fargo has exclusive rights to all foreclosure.com listing WHY? Anyway PAS trains Wells Fargo Preferred Vendors. So who is Jasmina Bevanda. I called her twice and she lied that she worked for a different company and could not pull up my mortgage nore send me any information. Her phone # is 612-312-9835. Back to Wells FArgo Home Mortgage Letter from Bonnie Schooler employee who lies and is in collusion to coverup intent by Wells Fargo Bank NA and Wells FArgo & Co and Wells FArgo & Co/MN and WFC HOLDING CORP to take property by deception.


"This letter is in response to your correspondence received on 8/31/2009, addressed to Honorable SEC Chairman Mary Schapiro of which a copy was went to the WFHM Fraud Department.


Our records indicate that WFHM previously received similar issues regarding your mortgage account to which WFHM has responded.  WFHM's position has not changed.


You have stated to several WFHM employees your concerns are with your closing attonrey and South Star Funding who originated and processed the second mortgage on your home.  WFHM is not associated with Sourth Star Funding and only purchased your second mortgage after it closed.  you will need to contact South Star Funding regarding your origiantion and processing concerns or consult an  attorney.  WFHM cannot get involved with a third party dispute.  WFHM considers this matter closed.

 I do know that the address presented was for GA for the real mortgage we signed on 6/7/20906 $352K 1st Mortgage with Wells Fargo Bank NA LENDER and 2nd Mortgage for $88K with South Star Funding LLC in GA.


who worked at the time in Parsippany NJ and reported to Sales Manager John Nelson at WFHM 15 Commerce Blvd, Suite 302, Succasunna, NJ.  Ajrona Leka (Admin) and Sales Associate assisted Greg Wareham who sold us 80/20 REFINANCE.  Ajrona Leka processed documents 5/4/2006 through 6/5/2006 in which she instructed the Wells Fargo Bank NA Attorney Stephen R. Scipione Esq. to 1) place the Title adding Star Mortgage Services for $88K for the closing to occur Friday (6/5/2006) and 2) WFHM fax sent to homeowners insurance company by fax from Atlantic Home Loans, Inc. phone# and address instructing Weichert Insurance to add to the FMI homeowners policy a 2nd mortgage for Star Mortgage Services for $67.5K.


I was privledged to secure copies of pre-loan origination documents from the very attorney who did the closings for Wells Fargo Home Mortgage now listed as defendant in the Compliant for Foreclosure (HOW they were not a company) they are not a legal entity at thetime of sale nor was Americas Servicing Company, nor is Star Mortgage Services, nor was the fictitous PO BOX in Kennesaw GA.  Structured Asset Funding Co (MD) and its fictitous name Capital Home Mortgage MD.


Wells Fargo Bank NA LENDER benefitted from the loan origiantion fraud and that is why John Stumpf who was given on 1/20/2009 copies of the loan origination fraud documents that clearly show a fraudulent closing occured 6/5/2006 (afterall I was not there and did not sign nor did I agree to the extra 5% in fees added onto the closing 3 closings in which Greg Wareham, Stephen Scipione, Mark Delaney Notary, Closer, Agent for Stephen Scipione Esq. brought to us 6/7/2006 mortgage and loan documents we saw for the very first time.  We did not know Wells Fargo Home Mortgage was not a legal business entity.  We did not know that Wells Fargo did not do consume rmortgages.  We did not know in secret covert operations that Wells Fargo sold our loan origiantion via a secret supply chain of Wells Fargo Preferred Vendors and only using Wells Fargo Commercial Clients and only Wells Fargo Subsidiaries and Wells Fargo Investors who concurrently placed currency into Wells Fargo Home Mortgage Institutional Lending for the asset-security side of the transactions depositing in Frederick MD funding from the 6/5/2006 transactions that Wells Fargo Bank  NA Attorney Stephen Scipione Esq. faxed 6/5/2006 and Wells FArgo Bank NA/MN 2650 Wells Fargo Way, Minneapolis MN 'Closer' Jasmina Bevanda and her mortgage counselor 'Julie Sainio processed the closings including a thank you letter asking Stepohen Scipione Esq. to rate Julie Sainio's services.


The pre-loan origiantion documents clearly show intent to take properties by deception.


Futher,  I've learned after May 2004 that all busienss was conducted by the legal entity Wells Fargo Bank NA dba Wells Fargo & Co of which none of the business entities are registered in NJ.


The Bad Faith and Wells FArgo & Co/MN Board of Directors trained the employees to use the supply chain they designed and sell to consumers one sales pitch and solict commercial business their primary job. IN fact the employees are required by job descriptions you can read on the internet to solicty professionals and to engage in community services in furtherance of business for Wells Fargo & CO/MN, Wells FArgo & Co., Wells Fargo Bank NA and WFC HOLDINGS CORP.


The bad faith includes the (intent to take property by deception) from consumers targetted and lied to or the legal term is deceived by deceptive advertising intended to influence consumer behavior.


Since Wells Fargo denies knowing anything about the mortgages on 6/7/2006 one of any sense would begin to realize the 6/5/2006 closing are normal business operations for Wells Fargo & Co, Wells Fargo & Co/MN and Wells Fargo Bank NA and WFC HOLDINGS CORP for on June 5, 2006 when loan origination fraud occured ( I know because I was not at the closing yet the documents were faxed with cut/pasted initials with a 6/5/2006 date and currency was funded 6/8/2006 and net funding deposited into the Wells FArgo Bank NA Attorney Account).


WELLS FARGO & CO, Wells FArgo & Co/MN, Wells FArgo Bank NA & WFC HOLDINGS CORP  HAVE harmed all consumers in all states substantively and greivously harmed the nation domestically and internationally.


John Stumpf has lied while testifying before the Legislature and his comments are recorded and in writing.


Wells Fargo & Co/MN 'WFC' dba Wells Fargo & Company dba Wells Fargo Bank NA (LENDER) (SERVICER). 


Wells FArgo does not do consumer mortgage and therefore nothing touched the Wells Fargo Bank, National Association and consumers were not protected by the OCC for our transactions were never seen (pre-loan origination documents hidden in local Wells Fargo Preferred Vendors).


In a huge 50 state pyramid scheme Wells FArgo sold in secret the loan originations for a fee and in secret converted the assets into debt and the business was given only to Wells FArgo Preferred Vendors and Wells FArgo Subsidiaries and Wells FArgo Commercial Clients.


Simultaneously the same date 6/5/2006 money was laundered into Wells Fargo 'Treasury' one of the subsidiaries or one of the Wells FArgo Commercial Clients processing accounting transactions in which Wells Fargo Home Mortgage Instituional Lending funding was taken in for investor of asset-security Structured Asset Funding Co (MD corp) and dba fictitous name Capital Home Mortgage. All of this done with other illegal names like Star Mortgage Services (UCC Document on file in NJ) and Cordova TN appers to be where the transactions may have moved and a forensic audit by the OCC will reveal where and when and what and how and who and why is obvious.


The fact is all of this was not done to ONE CONSUMER rather to all CONSUMERS and every state harmed and involves HomeLand Security and violations against the Patriot Act HR3162 and Gramm-Leach-Bliley Act November 1999 in which the Attorney General does indeed have Jurisdication. And violations against Sarbanes-Oxley Act 2002 which is probably what prompted Wells Fargo Home Mortgage, Inc. being merged into Wells FArgo Bank, National Association.


Wells Fargo may have gotten away with their selfish greed for almost a decade and almost did not get caught but their greed and lies and intent to harm my family revealed a series of transactions that lead not to local Wells FArgo Home Mortgage loan origianton fraud rather to how Wells Fargo operates and became the #1 Loan Origiantion Company and the #1 Loan Servicer and to do so it took lots of unlawful business acts and false claim acts.  If I understood the Gramm-Leach-Bliley Act Nov 1999 and FFEIC documents  financial holding companies are required to change the organization every 10 years.

Officially I entered into an agreement with John Stumpf 1/20/2009 when he accepted my valuable loan origiantion fraud evidence and agreed to perform a top/down investigation and Legal Services, Wells Fargo & Co/MN and Wells FArgo & Co & Wells FArgo Bank NA and WFC HOLDINGS assigned Bonnie Schooler WFHM division to investigate - she refused lied and processed instead of a HUD Loan Origiantion RESPA Investigation in which we would have been safe for 90 days while Wells Fargo investigated and then another six months while they investigated the loan origiantion fraud and they should have called in HUD to assist.  Rather they just wanted to see the documents and make me go away.


God is blessing us and we are still hanging in here and I pray my Governor who has under Article II of the Constitution Executive Powers will authorize the Attorney General who does have Jurisdiction per the Gramm-Leach-Bliley Act November 1999 to present a case as Plaintiff v. Wells Fargo Bank NA, Wells Fargo & Co, Wells Fargo & Co/MN, WFC HOLDINGS CORP and prosecute to the fullest extent of the law and take back what the US Constitution gives uss our civil rights under the Fourteenth Amendment, Fifth Amendment and Eight Amendment and US Constitution the right to be safe in life and property, the right to liberty, the right to due process and due process and all  protections of federal and state laws and US Constitution and State Constituion.


John Stumpf had he been an honest business man would have gladly performed a top/down investigation to stop loan origiantion fraud at the local level. But instead it is normal operations for Wells Fargo to place deceptive advertising into the public domain to influence consumer behavior and take our only asset and covert it to debt and at the time of sale indeed the manufacturer is responsible for selling what is a defective product at the time of sale which caused substantive and grevious harm.


 I asked for only what was due 1/20/2009 consideration of the fraud which would have meant I was to be given back what I  paid in and renegotiate the mortgage. 


Since the property is underwater the mortgage companies do not want to do that because the 2nd mortgage can be stripped off as unsecured debt. I did not know that then.


When I gave John Stumpf the copies of the loan origiantion fraud he and many employees lied to coverup the normal operations and committed additional unlawful business acts including intent to take property by deception and more flase claim acts for the Complaint for Foreclosure and the Assignemtn of All These Good Men also are fraudlent.

1) Wells Fargo Home Mortgage is Born right here in the USA in CA.

-   In the Year 2000, when Norwest purchased the 'Wells Fargo' invaluable logo they knew to chagne the names of certain companies but neglected to change America's Servicing Company.

-  In the U.S. a business entity is only legal to engage in commerce that is in the eyes of the law when the owners register the  business entity with the Secretary of State "SOS."

2) Wells Fargo & Co/MN (same employees Pete Wissinger and Richard Kovacevich and John Stumpf and Mark Oman and David Hoyt and James Smother all knew enough to so in 2000 registering Wells Fargo Home Mortgage, Inc.

- Norwest Mortgage in many states was allowed to expire involuntarily dissoved for non-compliance.

3) Norwest Mortgage thru 1999 had a trade name that is doing business as Americas Servicing Company.  The trade name is a fictitious name (not paying an annual fee to and in some states documents were processed

Only legal entities can engage in commerce as allowed under federal and state laws.

To do business in a state a corporation must register as a Domestic Corporation for Profit declaring the state it will do legal busines inside of.

IMPORTANT NEW DEVELOPMENTS AS OF FEBRUARY 10, 2009

   THIS SITE IS FOLLOWING THE DEVELOPMENTS IN THE BROWARD COUNTY, FLORIDA  lawsuit wherein Thomas Heinrich, the voice of Real EstateFinancing Today, has filed suit against Wells Fargo and it's alter ego America's Servicing Company which it runs from its Wells Fargo offices but has failed to register with State's Secretary of State offices or the Office of the Comptroller of the Currency, which Heinrich maintains makes Americas Servicing Company ineligible to transact business using the name Americas Servicing Company, and claims 'Americas Servicing Company' induced him into refinancing his small firstmortgage he took out with People's Choice Home Loan, Inc back in 2004 by offering him a fixed rate loan with no closing costs at about half the rate his current mortgage was at, but used that deliberately as a ruse to increase their $25 to $35 a month servicing income from his loan to additonal thousands of dollars of additional income for themselves at worst, and at best to steal his $100,000 plus equity in his property and leave him still being nearly $100,000 in debt to them, which is part of what Heinrich claims is the largest financial fraud operation in the history of mankind.

The last payment Heinrich made on his mortgage was for December 2007.     In January 2008 Wells Fargo instructed him to stop making his mortgage payments until they set the first payment on his new mortgage as being conditions for giving him a 6.200% fixed rate loan with no closing costs.

On January 29, 2009, Heinrich received a modification agreement from Wells Fargo requiring him to accept within four days their offer to move his January 1, 2008 payment to April 1, 2009.   He would have to pay them $3,299.97 closing costs, which they did not break down, in order to do so, but they would keep his high rate adjustable loan the same interest rate as it had been all along and it would otherwise stay fluxuating the same as if nothing had been changed on his loan, except they were reducing his monthly payments to a pay rate at 5.99%, making his loan into a Negative Adjustable for 25 years with a huge balloon payment at the end.  The Comptroller of the Currency admitted that neither "Americas Servicing Company" nor "Wells Fargo Home Mortgage, Inc" (which Wells had previosuly identified as being the owner of ASC) had been properly registered with the OCC.  Heinrich says that even Wells Fargo's defense lawfirm, Carlton Fields, seemed surprised by Wells Fargo's moves.  The litigation now ramps up with what assuredly will become a case of national significance.

Norwest Mortgage purchased Wells Fargo 'Logo' in 2000.

In 2000 the Norwest Mortgage business entity tradename for Americas Servicing Company (tradename) did business as Norwest Mortgage.

Because Wells FArgo Home Mortgage, Inc did not process trade name update they were not legally using America's Servucing Company name dba Wells Fargo Home Mortgage, Inc. which thru May 2004 was a Domestic for Profit Corporation in California.

In OH one can find yet on the Secretary of State of OH database Norwest Mortgage tradename Americas Servicing Comapny involuntarilly dissolved in 2000 due to non-compliance.

The fact of the matter is Wells Fargo Home Mortgage nor Wells Fargo & Co. nor Wells Fargo & Co/MN actually did not file an update recording with the Secretary of State of OH nor perhanor WFC HOLDINGS CORP nor wholly owned subsidiaries nor....

Did not pay the fee to record and legally continue using Americas Servicing Company.

I called Denise Dofflemyer who works for Wells Fargo at 240-586-7707 on a weekend and left a message for her to call me as I wanted an ID to login to make a payment.  Consumers can make a phone payment on their Wells Fargo Home Mortgage and MERS mortgage payments on the 866-674-1430 Americas Servicing Company phone#.


All Wells Fargo Home Mortgage consumers can use their Wells Fargo Home Mortgage loan numbers and the last four numbers of the SSN of one of the loan recipients who may or may not have signed.


Denise can only give out a secure id for the login screen above to 'investors' was the exact word she used.


Denise said "Consumers are not allowed to use that login" and have to call the 866-674-1430 phone #.


Consumers (I use to be one) do not understand the difference as reasonable people.

I had to go to school to learn how to understand what Wells Fargo did to our nation and us consumers.


Fact of the matter is indeed Wells Fargo & Company engages in many Commercial Relationships and calls those people Customers and Clients which includes investors.


Wells Fargo & Co. is a financial holding company and under Gramm-Leach-Bliley Act November 1999 are required every 10 years to turnover the accounting which Wells Fargo is doing moving all of the company names around.  Wells Fargo does not have to move around Wells Fargo Home Mortgage, Inc. which was voluntarilly dissovled and merged out of existence in May 2004 in California and a handful of other states like SD and MD and DE where the OCC and SEC might notice paperwork was not filed.


But in NJ no paperwork was ever filed.  Wells Fargo Home Mortgage, Inc. involuntarily dissolved and merged out of existence for non-compliance - not providing the annual report and 2003 forward Wells Fargo & Co did not pay the money to voluntarilly dissolve nor notify the Secretary of State in all 50 states just some saving themselves a lot of money.


Thereafter they continued doing exactly what had been done since 2000 which is selling in secret giving all of the loan originations to Wells FArgo Preferred Vendors and all of the business to Wells FArgo Commercial Clients and to Wells Fargo & Co. subsidiaries which is how they in 2000, and forward had such higher numbers than anyone else.


All players rewarded including employees of Wells Fargo & Company for looking the other way including the Board of Directors who profitted and engage in unlawful business acts, false claim acts and are in direct violation of Gramm-Leach-Bliley Act November 1999 and such Act does provide each Attorney General with the authority for Jurisdiction to take down Wells Fargo & Co and Wells Fargo & Co/MN & Wells Fargo Bank NA & WFC HOLDINGS CORP.... including HSBC and ....


I pray for intentionally discriminating against a class of people all consumers who purchased consumer mortgages from 'Wells Fargo Bank NA' that each states Attorney General can bring forth in their state a product liability suit conjoined to who I pray is the first state New Jersey


Every consumer who purchased what they believed to be a Wells Fargo Consumer Mortgage was sold a defective product indeed defective at the time of sale.

SUMMARY JUDGMENT


Bank Nevada, N.A. (“WFBN”); Wells Fargo Insurance, Inc.


(“WFII”); and Wells Fargo Home Mortgage Co., Inc. (“WFHM”) are


affiliates of Wells Fargo Bank that use Wells Fargo customer


information to sell credit card, insurance and mortgage products


to Wells Fargo Bank customers.


All Plaintiffs maintain offices or conduct business and


other activities in Daly City, San Mateo County and Contra Costa


County, California.





The Court declares that the ordinances


at issue are preempted under federal law to the extent that the


ordinances restrict the sharing of confidential consumer


information between financial institutions and their affiliates.


The Court enjoins enforcement of the ordinances to that extent.


The Court upholds the ordinances’ restrictions on the sharing of


information between financial institutions and non-affiliated


third parties.


Plaintiffs seek a judicial declaration that the


ordinances are preempted by the Fair Credit Reporting Act


(FRCA), 15 U.S.C. §§ 1681 et seq., the Gramm-Leach-Bliley Act


(GLBA), 15 U.S.C. §§ 6801 et seq. and the National Bank Act


(NBA), 12 U.S.C. §§ 21 et seq.

They also seek a permanent


injunction barring Defendants from enforcing the ordinances and


attorneys’ fees pursuant to 42 U.S.C. §§ 1983 and 1988.


The three ordinances, which are substantially similar, are


intended to afford consumers greater financial privacy


protection than is provided in the federal GLBA. See CCO § 518-


4.202(a); DCO § 5.92.010(a); SMO § 5.140.010(a).

The ordinances bar financial institutions operating in the


relevant jurisdictions from disclosing or sharing confidential


consumer information to affiliates or non-affiliated third


parties without written notice to the consumer and a consent


acknowledgment from the consumer. See CCO § 518-4.602(a); DCO


§ 5.92.020(a); SMO § 5.140.030(a). Essentially, the ordinances


require financial institutions to obtain a consumer’s consent,


or “opt-in,” prior to releasing confidential information about


the consumer, rather than merely requiring the banks to allow


consumers to “opt-out” of such information disclosures.

1. Fair Credit Reporting Act


Plaintiffs argue that the ordinances are preempted by the


preemption provisions of the FCRA, 15 U.S.C. § 1681t(b)(2),


insofar as the ordinances impose restrictions on the sharing of


confidential consumer information between financial institutions


and their affiliates, such as between Bank of America and its


affiliate Bank of America, N.A. (USA).


The question the Court must resolve is the breadth of this


preemption provision and whether it encompasses the ordinances


at issue in this case. This appears to be a question of first


impression in this circuit.2


The Court is aware of only one, unreported, opinion


addressing preemption under § 1681t(b)(2), Cline v. Hawke, 51


Fed. Appx. 392 (4th Cir. 2002) (unreported). That opinion


addresses § 1681t(b)(2) only in passing, noting that


§ 1681t(b)(2) was listed as an additional basis for preemption


in an United States Office of the Comptroller of the Currency


(OCC) letter concluding that a West Virginia insurance consumer


protection statute was partially preempted under the GLBA and


other federal statutes. See id. at 397. The OCC letter states


in pertinent part:


The FCRA preemption provision ensures that affiliated


entities may share customer information without


interference from State law and subject only to the FCRA


notice and opt-out requirements if applicable. The


preemption is broad and extends beyond state information


sharing statutes to preempt any State statute that affects


the ability of an entity to share any information with its


affiliates. Congress intended the preemption provision to


establish a national uniform standard in this area, noting


that “credit reporting and credit granting are, in many


aspects, national in scope, and that a single set of


Federal rules promotes operational efficiency for industry,


and competitive prices for consumers.”

15 U.S.C. § 1681a(d)(1). A “consumer” is defined as “an


individual.” See id. at § 1681a(c).


Defendants base this argument that the term “information”


as used in § 1681t(b)(2) should be construed to mean “consumer


report” on the intent of the CCRRA amendments. According to


Defendants, the CCCRA amendments were enacted, inter alia, to


clarify that information shared between affiliated companies


should not be treated as a consumer report regulated under the


FCRA.


Defendants contend that the intent of the CCRRA amendments

“Person” is defined to include a corporation or other


entity. See 15 U.S.C. § 1681a(b).

Wells Fargo CMBS Live on MERS Commercial


San Francisco, Calif—The Commercial Mortgage-Backed Securities division of Wells Fargo is the first lender to fully integrate the MERS® Commercial system into their operations.


"Wells Fargo is very excited about using MERS," said Susan Sagouspe, Vice President of the Commercial Mortgage Group for Wells Fargo. "It will save us a tremendous amount of time and money to eliminate preparation and recordation of assignments. When all lenders are utilizing MERS, our Borrowers will benefit by speedier assumptions."


MERS Commercial, a new product from MERS, is targeted for the CMBS and multifamily marketplaces. It is designed to eliminate the repurchase risk and costs associated with preparing, recording and tracking assignments.
