Bank of America Foreclosure Agents Owe Duty to Borrowers as well as Bank

The Attorney General in Washington state announced a lawsuit against Recon Trust for not acting as a neutral third party when foreclosing on properties. After an investigation, the Attorney General filed a lawsuit alleging that there was a duty to the mortgage holder as well as the bank, and the foreclosing trustee Bank of America used was not acting as a neutral third party.
This is great news for foreclosure attorneys in Washington state. The lawsuit can be cited in a complaint as evidence that there was an improper foreclosure.
