WAMU SETTLEMENT ENOUGH?

WAMU Shareholders Get Settllement Based on Bad Loan Practices

MOST POPULAR ARTICLES

EDITORS COMMENT: Is it me? Or does it seem that everyone — investors, governments, and anybody BIG is getting paid hundreds of millions of dollars or even billions of dollars from all the big players in the securitization (derivative scam) but NOBODY is asking to apply these settlements to the Borrower’s obligation. The figures are wrong in the settlements, wrong in the foreclosures, wrong at the auction, wrong on demands for adequate protection and wrong on supercedeas bond.
When is somebody going to ask the the FULL accounting from the investors on down to the borrower and start doing simple arithmetic. These loans are (a) not in default (b) partially or completely paid off by third parties (c) subject to various counterclaims and defenses that would set-off against the principal demanded, (d) not secured (e) discharged in bankruptcy.
Washington Mutual Settles Fraud Suits for $208 Million
By REUTERS
Washington Mutual’s officers, directors, underwriters and auditor have agreed to a $208.5 million settlement to end class-action securities fraud lawsuits, according to court documents.
The settlement is among the largest stemming from the financial crisis, behind a $624 million settlement by the Countrywide Financial Corporation and $475 million by Merrill Lynch & Company.
The lawsuits, in the United States District Court for the Western District of Washington, accused the defendants of concealing from investors poor loan underwriting and inflated appraisals that overstated earnings and inflated the company’s stock price.
As the housing market began to crash, Washington Mutual’s loans soured at an alarming rate. In September 2008, regulators seized the company’s savings and loanbusiness in the largest bank failure in the nation’s history.
The day after the seizure, the bank holding company, Washington Mutual, filed for bankruptcy.
Under the terms of the class-action settlement, announced in court papers dated Thursday, claims against the directors and officers will be settled for about $105 million.
About a dozen underwriters of the company’s securities contributed $85 million to the settlement; the company’s auditor, Deloitte & Touche, contributed $18.5 million.
The settlement is subject to court approval.

  1. Well Neil, I think the main issue is that the homeowner received a lump sum of money, to which they used to purchase or renovate a home. However nefarious means were used for that money to eventually make it’s way to the homeowner seems to be immaterial. But, I hope you are correct in that the homeowner’s obligation has to be affected by these payments in some way. I wonder if any of the cases winding their way through the system are arguing for just such an accounting.

WELLS FARGO, CAN'T YOU FIND SOMETHING GOOD TO DO?

IMMIGRANT RIGHTS GROUP

PROTESTS BANK'S INVESTMENTS

A local immigrant rights group is ca
lling
for a boycott of Wells Fargo bank for investing in funds that benefit for-profit prison companies.

About a dozen people affiliated with Tennessee Immigrant and Refugee Rights Coalition set up outside the Wells Fargo bank on Fourth Avenue in downtown Nashville to ask the company to stop overseeing a mutual fund that invests in the Nashville-based Corrections Corporation of America and another private prison company, The GEO Group. Advocates say private prisons profit from the over-incarceration of people, particularly immigrants.
“They have a vested interest in locking up more people for longer periods of time,” said Alex Friedman, associate editor with the Human Rights Defense Center. “That is a perverse interest when it comes to criminal justice.”

Friedman was among a group of people who said they closed their bank accounts with Wells Fargo on Friday in protest of the for-profit prison industry and concerns that the companies were influencing legislation that would lead to more incarcerations and, as a result, bigger profits.

Wells Fargo responded that it doesn’t actually own any shares of either for-profit prison company but manages mutual funds that include for-profit prison companies.

“Wells Fargo does not own shares of the GEO Group or CCA, nor have we invested our own assets in either company,” said a statement provided by the company. “We’ve been proud to serve the Hispanic community and other individuals who’ve immigrated to the United States since our earliest days as a financial services provider.”

Steven Owen, spokesman for CCA, said the company has a policy against advocating for any crime or sentencing policies and did not lobby for recently passed immigration enforcement laws in Arizona and Georgia.

“We respect the group’s right to protest, but this does nothing to help find solutions to a challenge that only grows in cost and complexity,” said Owen. “Fortunately, credible public and private institutions are partnering together and working hard to create and implement safe, humane and cost-effective ways that respect the dignity of the detainees and inmates entrusted to our care.”

The GEO Group could not be reached for comment.

According to Bloomberg, Bank of America Corp. (BAC - Analyst Report) will retrench 60 employees in its equity sales and trading unit. The decision was taken to boost revenue in the unit by lowering expenses.

The division, comprising approximately 2,500 people, plans to fire least-productive employees globally. BofA also announced jobs cut of approximately 100 employees in its consumer and small business banking unit as of March 2011. The layoffs are part of BofA's ongoing efforts to overhaul its consumer banking unit.

Further, another mega bank, Wells Fargo & Company (WFC -Analyst Report) has cut 49 jobs in its financial card collections department in Sioux Falls. In January 2011, Wells Fargo also announced to reduce 120 workers in its student loan operations, including many in Sioux Falls, though the company planned to transfer most of the employees to other units.

In March 2011,Wells Fargo also announced that it will lay off approximately 200 employees, including 82 employees in San Antonio, 30 in Addison and 67 in Bedford, Texas in its home mortgage division.Wells Fargo employs about 13,000 people in metro Des Moines. The company’s Home Mortgage division, which is based in West Des Moines, captures approximately 25% of the U.S. home lending market.Wells Fargo also announced the elimination of 68 positions at a Vancouver call center, which supports collection of loans for Wells Fargo Financial division, the company’s consumer finance subsidiary. The action followed as the customers are paying down debt, eliminating the need for debt collectors.

Many large Wall Street banks have started reducing their workforces to cut costs following the slowdown in economic and market activity. Further, some large Wall Street banks are laying off employees due to weak trading volumes and stringent regulations on some parts of their business.

On Wednesday, The Goldman Sachs Group Inc. (GS - Analyst Report) also stated its intention to lay off 230 workers in New York State due to economic reasons. The layoffs will be executed during the fourth quarter of 2011 and the first quarter of 2012.

Goldman's New York layoffs represent less than 1% of its 35,400 employees as of March 2011. The layoffs would be in addition to the company's annual retrenching of workers, who perform in the bottom 5% or so. However, Goldman is also hiring employees in China, India and Brazil following growth in such markets.

Credit Suisse Group AG (CS - Snapshot Report) is among the other Wall Street banks that are planning to reduce cost by retrenching employees as they are struggling with reduced revenue from trading stocks and bonds. Further, according to a regulatory filing, Bank of New York Mellon Corp. (BK - Analyst Report) also informed the labor department about its plans of cutting 124 jobs in its treasury services operations lockbox. The jobs cut will take place in segments beginning July 1, 2011 and continue through March 31, 2012.

We believe that the present job cuts will enable banks to reduce expenses, alleviating bottom-line pressure.

Both Wells Fargo and BofA currently retain Zacks #3 Rank, which translates into a short-term ‘Hold’ rating.
